A repeat infringer is a user who has been the subject of:
- More than two (2) valid DMCA takedown notices, or
- A final judicial determination of copyright infringement, or
- Multiple instances of posting clearly infringing content
6.2 Enforcement Actions
For repeat infringers, we may take the following actions:
- First offense: Content removal and warning
- Second offense: Temporary account suspension (7-30 days)
- Third offense: Permanent account termination
- Egregious violations: Immediate permanent ban
7. User-Generated Content
Pixel Crowd is a platform that hosts user-generated content. We do not pre-screen all content, but we take copyright infringement seriously.
7.1 User Responsibilities
- Only upload content you own or have permission to use
- Respect copyright, trademark, and intellectual property rights
- Do not share pirated software, games, or media
- Provide proper attribution when using licensed or permitted content
- Remove content immediately if requested by the rights holder
7.2 Fair Use
Some uses of copyrighted material may be considered "fair use" under U.S. copyright law. Fair use is a legal doctrine that permits limited use of copyrighted material without permission for purposes such as:
- Commentary and criticism
- Parody and satire
- News reporting
- Educational purposes
- Transformative works
However, fair use is determined on a case-by-case basis and is not a blanket defense. If you believe your use constitutes fair use, you should consult with a legal professional.
8. Trademark and Other Intellectual Property
While this policy primarily addresses copyright, we also respect trademark and other intellectual property rights.
8.1 Trademark Complaints
If you believe your trademark is being infringed on Pixel Crowd:
- Contact us at legal@pxlcrowd.com
- Provide proof of trademark ownership (registration certificate)
- Identify the infringing use and its location
- Explain how the use causes confusion or dilution
8.2 Other IP Claims
For other intellectual property claims (patents, trade secrets, etc.), contact our legal team at legal@pxlcrowd.com with detailed information about your claim.
9. Misrepresentation and Abuse
The DMCA provides remedies for victims of false claims. Under 17 U.S.C. § 512(f):
- Any person who knowingly materially misrepresents that material is infringing may be liable for damages
- Any person who knowingly materially misrepresents that material was removed by mistake may be liable for damages
- Damages may include costs and attorneys' fees
We take false DMCA claims seriously and may suspend or terminate accounts of users who abuse the DMCA process.
10. Safe Harbor and Limitations
Pixel Crowd qualifies for "safe harbor" protections under the DMCA as a service provider hosting user-generated content. This means:
- We are not liable for copyright infringement by our users
- We respond to valid DMCA notices expeditiously
- We have a repeat infringer policy
- We do not have actual knowledge of infringing activity until notified
However, safe harbor does not exempt us from our responsibility to respond to valid DMCA notices and remove infringing content.
11. Content Restoration and Disputes
If content is removed due to a DMCA notice and you believe it was removed in error:
- File a counter-notice using the procedure in Section 5
- Wait for the counter-notice process to complete (10-14 business days)
- Content may be restored if the complainant does not pursue legal action
- Alternatively, reach out to the complainant to resolve the dispute directly
12. International Copyright Issues
Pixel Crowd operates globally and respects international copyright laws. While this policy is based on U.S. copyright law (DMCA), we also respond to valid copyright claims under:
- European Union Copyright Directive
- Berne Convention for the Protection of Literary and Artistic Works
- Other applicable international copyright treaties and laws
If you are submitting a claim based on non-U.S. law, please specify the legal basis and jurisdiction in your notice.
